A History of Workers’ Compensation

Workers’ Compensation was the first form of social insurance to become available across the United States. By design, it provides cash benefits and medical care to employees who have suffered a work related injury or disease. It can also provide survivor benefits to the dependents/families of workers whose deaths directly resulted from a work related accident or disease.

The federal government was the first to establish a Workers’ Compensation program. The program covered their civilian employees with an act that was passed in 1908. This early form of Worker’s Compensation provided benefits for workers engaged in hazardous work. The rest of the federal employees were covered in 1916. Nine states enacted Workers’ Compensation laws by 1911. And by 1921, only six states had yet to pass Workers’ Compensation laws. Today, every state has their own programs and laws. The federal government covers its employees through its own separate program.

According to the most recent statistics available, national payments under Workers’ Compensation programs totaled more than $61.8 billion in 2012, which was a 1.3% increase from the 2011 benefit figure of $61.0 billion. In 2012, medical benefits accounted for $30.8 billion, and wage loss compensation accounted for $31.0 billion. The latter amount includes payments to disabled workers and the survivors of deceased workers.[1] General consensus is that these figures will continue to rise as the population and workforce numbers increase over time.

The Three Types of Workers’ Compensation Benefits in New Jersey In New Jersey, injured workers may be entitled to three different types of benefits under Workers’ Compensation Law. Do not rely upon your employer to inform you of your rights to these benefits.

  • Temporary Disability Benefits: wage benefits based upon the average gross weekly wage for 26 weeks prior to the date of injury up to a maximum amount of 70% of your weekly wage. Injured workers are entitled to temporary disability benefits so long as they are unable to perform their job as per the opinion of a physician. Medical Benefits: The injured worker is entitled to receive reasonable and necessary medical treatment to be paid for through Workers’ Compensation.
  • Permanency Benefits: A monetary award based upon the disability in question. It is only necessary to prove that the injured area has not healed to function as it did prior to the injury occurring.
