By providing defendants with an alternate path instead of the more conventional prosecution/sentencing, the Pretrial Intervention Program (PTI) seeks to deter criminal behavior in the future. PTI offers rehabilitation services in lieu of jail time in situations where a reasonable connections can be made between the illegal behavior and the rehabilitative needs of a defendant. The idea being that social, cultural, and economic conditions are often the root cause or the reason why a person may have committed a crime. The objective of PTI is to help a defendant resolve the personal problems in their lives that seemingly lead them down this path. By doing so, people who enter PTI will hopefully be less likely to be involved in criminal behaviors in the future. Any person charged with an indictable offense can apply. There are some admission guidelines that are reviewed case by case. Discuss your particular criminal history or lack thereof with an attorney to determine if you are a good candidate. As one would assume, there are rules once accepted into PTI. On average, supervision under PTI will last for one to three years. Conditions will vary, but drug testing, community service, restitution payments, fees/fines, and psychological/drug/alcohol evaluations are common. When PTI is successfully completed, the original charges are dismissed and there is no record of any conviction. If a defendant fails to successfully comply and complete PTI, the criminal case against them will proceed.

Successful completion of PTI can have truly magnificent impact. The defendant avoids a criminal record. The programs and rehabilitation services can change a defendant’s life for the better by providing the much needed support system required to foster success. Some court fees are eliminated, causing less financial burden on the defendant. PTI is a timelier and less invasive resolution of a case which is often better for the victim, public, and defendant.

You have five weeks starting from the day you are indicted to submit your application. Do not hesitate. A defendant will then be interviewed by the court. A report would then be provided to the prosecutor and your attorney. If accepted, the terms and conditions for participation are set and agreed upon between the prosecutor and your attorney before participation is official. If not accepted, you can appeal.
