Driving Without Insurance in New JerseyDriving without insurance is one of the more serious motor vehicle offenses in New Jersey. There are particularly harsh penalties for those found to be in violation of N.J.S.A. 39:6B-1, the law that requires every owner or of a vehicle in the state to carry liability insurance coverage. The first time someone violates the law, they are subject to a fine of at least $300 and up to $1,000, community service, DMV surcharges of $250 for three years, and a mandatory license suspension of one year. There may also be additional court costs and fees. A second offense carries a fine of up to $5000, a mandatory jail sentence of 14 days, 30 days community service, and a license suspension for two years. Even after two years, the driver’s license will not be automatically returned, the person must apply for reinstatement.
“No Pay, No Play”New Jersey requires that all drivers to carry liability insurance. In addition to the fines, penalties, and even jail time noted above, uninsured drivers also run a risk of being subject to “No pay, no play”. What “No pay, no play” means is that if you are injured in a car accident that is somebody else’s fault, and you did not have insurance at the time of the accident, you may be prohibited from recovering any recovery money from the at fault driver. It is essentially a punishment that bars you from benefiting from the liability laws when you are not complying with the law yourself.
