Family & Mediation

FAMILY LAW & MEDIATION

The Family Law attorneys at Malamut & Associates, LLC work to support you through the legal process, regardless of your situation. If you’re dealing with a potential divorce, issues that have arisen after your divorce, an adoption, looking for mediation alternatives or dealing with a myriad of family law issues, we are here to help. Our compassionate approach relies on effective and honest communication that keeps our clients informed of their options while protecting them from potential pitfalls in the legal process.

Alimony
Determining whether alimony/spousal support is appropriate in any given case, as well as the amount and duration, requires a fact-specific analysis of many factors. Whether you are the supporting or supported spouse, you have rights that we can assist you in protecting so that you have adequate means to support yourself.
Divorce
Dissolution of your marriage is a major life event that brings about change in many aspects. Our goal is to shepherd you through the challenging process in a way that preserves as much of your marital assets as possible.
Contested Divorce
Some cases require a well-presented argument to the Court to achieve the result that you want. Some also require the presentation of testimony and evidence so that a decision can be reached in your best interest.
Uncontested Divorce
A divorce is “uncontested” when both parties are in agreement with regard to the dissolution of the marriage and the issues related to child custody, support, asset and debt distribution. In this circumstance, our goal as your advocates will be to achieve a result by agreement that is satisfactory to you.
Property Division
Property division involves a consideration of a number of factors set out in the New Jersey statutory law regarding equitable distribution. Applying those factors as they pertain to the unique circumstances of your case will lead to a fair division of the marital estate.
Separation
Although New Jersey does not recognize the term “legal separation”, there are lawful means of achieving a “limited divorce” if your circumstances call for it.
Child Custody/Support
Child custody and support issues can often be the most difficult area for divorcing/separating parents to address. There are often creative solutions that our team can propose for you that are in the best interest of your child or children.
Parenting Time
Parenting time schedules vary from case to case and require consideration of the unique dynamics of your own family, including work schedules, the age and activities of the children, the geographical distance between parents and so on. We specialize in devising and crafting parenting time plans that work for our individual clients.
Paternity
At times, a question of paternity can arise with regard to a child. Depending upon the outcome of genetic testing, additional issues can arise with regard to child custody, parenting time and child support, all of which our team can assist you with.
Post-Judgement Family Issues
Family issues often continue well beyond the entrance of a divorce decree. The factors pertaining to alimony and child support can change, issues related to one party’s violation of a divorce judgment or agreement can arise and brand new issues, such as college for older children, can come to light. These post-judgment matters often require good legal counsel.
College Issues
Where children attend college and how the rising costs of college are managed are issues with which parents frequently need assistance. Whether a motion is required or whether an agreement can be brokered regarding college-related issues, our office is here to assist.
Emancipation
The law in New Jersey has recently changed with regard to how emancipation issues are dealt with by our courts. Each case is fact-specific and requires legal guidance in determining the appropriate time of emancipation and the consequences of it.
Mediation
Many cases are appropriate for family mediation to resolve the issues in a given case by agreement, rather than litigation. Mediation is a more affordable, efficient and less stressful means of achieving a fair result. As a court-approved family mediator, Annmarie Jensen, Esquire can serve to facilitate a mutually-agreeable arrangement between you and your spouse.
