Municipal court matters are often taken far too lightly. If you have been charged with a violation of New Jersey law and are required to appear in municipal court, the consequences can be significant. A traffic violation, DUI, or Drug Possession can result in the suspension of your driving privileges, monetary penalties, community service, increased auto insurance premiums, and even jail time. Matters of the Municipal Courts may seem like they are no big deal. That is, until you’re standing in front of the prosecutor or judge with nothing to say in your defense. Sure, some people can handle their own Municipal issues successfully without a lawyer. Maybe they will get the best possible outcome. Maybe they won’t. They probably don’t know if they did or they didn’t. Sadly, the majority of people who go it alone wish they had the foresight to seek legal advice before walking into that courtroom. If you or a family member are facing charges in the municipal courts, do not hesitate to contact Malamut & Associates today. Good counsel can mean all of the difference.

Why Your Driver’s License may be Suspended or Revoked in New Jersey

As anyone who pays insurance premiums knows, New Jersey has a point system for driver’s licenses. The state has predetermined point values associated with traffic offenses. A suspension is possible if you have accumulated 12 points within two years or 15 points in a period greater than two years. There are courses that can be completed that would help stave off a suspension. Certain criminal convictions may also result in a suspended or revoked license. An example of this would be that your license may be suspended or revoked for between six months or two years for a drug conviction. You may also lose your license if involved in an accident that injures or kills someone. For this to happen, there are usually other circumstances involved such as speeding, DUI, or other recklessness.

Penalties for Driving on a Suspended or Revoked License in New Jersey

If you are charged with driving during while your license is suspended or revoked, you could be fined or even receive jail time. For a first offense, you can be fined $500. For a second offense, you could be fined $750 and given a jail sentence between one and five days. For a third offense, you could be fined $1,000 and given a MANDATORY jail sentence of up to 10 days. Contact Malamut & Associates today to schedule a free consultation.

The length of sentence imposed by the courts will likely depend on the reason for your license being suspended or revoked. For instance, if you are driving with a suspended or revoked license and you are involved in an accident that injures someone, you could be sentenced to between 45 days and 180 days in jail. If your license is suspended or revoked due to DUI, you could be sentenced to between 10 and 90 days in jail. If suspended or revoked due to insurance violations, you could be sentenced to up to 90 days in jail. DUI while driving while on a suspended or revoked license could also exacerbate the penalties.

Is there any point to contesting a Driving While Suspended or Revoked?

Yes. There is clear upside to contesting this charge. By paying the ticket, as issued by the officer, you are voluntarily adding points to your record, and subjecting yourself to any additional penalties the court imposes. This could land you in jail. Malamut & Associates attorney’s experience with municipal court system prosecution and defense gives us unique insight as to how and why tickets/charges could be reduced to a lesser violation or rescinded completely.
